Chapter 41, Title 41, Idaho Code, is applicable to all self-funded plans established by public agencies pursuant to a joint powers agreement in accordance with Chapter 23, Title 67, Idaho Code, for provision of health care service benefits to employees of public agencies in connection with or as an alternative to insurance and other prepayment plans.

No joint public agency self-funded plan shall operate in the State of Idaho except while registered with the Director. Plans subject to regulation must be registered with the Idaho Department of Insurance, file periodic financial statements and other required filings (such as an annual audit and actuarial opinion), as well as requested information, and are subject to examination.
