Applying for Certificate of Compliance
Each cigarette in a brand family must be certified. “Brand Family” means all styles of cigarettes sold under the same Manufacturer/Trademark and differentiate from one another by means of additional modifiers or descriptors including, but not limited to: “100’s”, “Kings, “Lights”, “Non Filter”, etc.
Each manufacturer shall maintain copies of all testing reports conducted on all cigarettes offered for sale for a period of three (3) years and shall make copies of these reports available to the Idaho State Fire Marshal and Idaho Attorney General upon written request. Testing of cigarettes shall be conducted in accordance with the American Society of Testing and Materials (ASTM) Standard E2187-04.
Markings shall be in eight (8) point type or larger. The markings shall consist of: Modification of the Universal Product Code (UPC) to include a permanent, visible, alphanumeric or symbolic mark printed at or around the UPC; and a permanent, visible, alphanumeric or symbolic mark printed upon the cigarette package or cellophane wrap or text that indicates the cigarette meets Idaho Statute 39-8905. A manufacturer shall use only one (1) marking and apply it uniformly for all packages. Modifications must be approved by the state fire marshal.
Any changes to any packaging and cigarettes, or additions to a brand family must submit a supplemental application and proof of those changes.

- Sample of the markings to be used on packages. Must provide a sample of each cigarette style listed for certification. PDF files are accepted on disk or USB drive.
Renewing Certifications:
- Complete application 3-5

- Updated Laboratory Testing Certificates
- Sample of markings ONLY if there are
Earliest to renew is 6 months prior to the certification expiration date.
